Why This Site Exists
As the owner of a home in Pleasantview Community in Fishers Indiana, my family, wife and business was attacked by a fraudulent HOA board in April of 2015. At that time I already knew they were not a legal entity and we chose to fight back instead of backing down from a group of criminals that continue to this date 4/20/17 to try to hurt us and go as far as have Indiana laws changed in an attempt to strip us of our rights of home owners and community members. This site will be used to continue to educate others that may be dealing with these types of people and criminals. This site will help you recognized red flags that can warn you of activities that may be those of a rogue or illegal board or even property management company. Don't be fooled by a management company that plays the part of the good guys, they are often part of the problem and because they made mistakes early on in getting into bed with a rogue board they end up compounding problems that can have a severe impact on your life.

Another HOA that feels that attacking homeowner with disabilities is a good idea comes forward with her story.
HOA's has received a green light from Indiana Representative Todd Huston
to go after Indiana Homeowners by changing the law HB 1074. The most recent changes that took place in March 2017 now allow any HOA (legal or not) to come after homeowners and strip any ability to defend themselves away in one motion. Read the changes here.
Notice that Representative Huston has removed the ability for a homeowner to raise an affirmative defense to protect themselves from an HOA that may not even be a legal entity based on the communities governing documents. Based on this new change as long as an HOA has their Secretary of State filings in order, they do not have to comply with the bylaws, covenants or any CCR documents that help to protect homeowners. Well, then let me share a very brief story with you.
While I was being sued by my HOA at Pleasantview, (turns out they were and still are an illegal entity) Indiana changed HB 1074 to allow proxy votes for elections and to allow proxy votes to count for amendments. Since there was no reason to change this law, it seemed strange that it just happened to had been changed at the same time that the HOA was trying to get the courts to reverse the court's decision to retroactively apply the new law against us. The court denied their request but who would change a law at this particular time? Why would they feel the need to change it?
Turns out that Representative Todd Huston felt it as important because he was the one that signed off on having it changed. Here is the exact statement from his office.

The next question to ask yourself is...who is Pleasantview Home Owners Association and who are the multiple members of Fishers local government?
Well, I can tell you that Jeffrey Bellamy represents the illegal HOA Pleasantview Home Owners Association, so Mr. Huston's assistant must be talking about him. So, the lawyer that represents the illegal HOA board submits a change in law to Todd Huston and Mr. Huston decides that it is a good idea and signs it for approval into law. WOW.... So a lawyer that lost the suit that they filed against me, was so desperate for a win that he had to resort to trying to change the law to cause further injury to us and our Indiana State Representative Todd Huston approved. Does this story sound like corruption to any of you reading this?

Channel 6 News Exposes Corrupt HOA's
Here is a developing story that will continue to get bigger over time so please pay attention to this video. Kara Kenney from WRTV news is currently investigating corrupt HOA's and how the Attorney General's office is pretty much helpless for the most part to do anything about it. There are others that are also looking into these HOA's so stay tuned. This story has legs all the way to the top.

Main street management mailed out a "revised" letter about the special meeting on 11/17/16 which discusses the election of the new board members.
